Alan Eadie, Partner, has been quoted in The Sunday Times (15.2.09) in relation to the high profile Colin McRae case.
The broadsheet highlighted the fact that McRae’s family may not receive any life insurance payment following the revelation that Mr McRae was piloting his helicopter without a valid pilot’s licence when it crashed, killing Mr McRae and his passengers.
Despite suggestions that McRae was flying in breach of air regulations by flying closer than the requisite 500 ft to “any person, vessel, vehicle or structure”, Alan’s view was that:
“It’s all dependent on the wording of any policy. All insurance contracts are subject to a duty of disclosure and good faith. Even if he was flying recklessly, my feeling is that it would not of itself void the claim.” Alan added that “the claim was more likely to fail over McRae not having a valid licence.”
