The Last Weekend – Have any applications arrived?
The law says that a properly addressed, pre-paid and posted application will be served “at the time at which [it] would be delivered in the ordinary course of post”.
When your RSL offices open on 1 August, will any post have arrived in “the ordinary course of post” yet? IF NOT, anything already delivered by post and in the office on arrival of staff (already behind the door) can be assumed to have arrived and been served before 1 August.
An RSL may wish to take the same approach with hand deliveries. An application already in the office when staff arrive on 1 August may be assumed to have arrived prior to 1 August, as staff will be unlikely to be in a position to prove otherwise and a consistent approach seems best.
On and after 1 August?
Tenants who attempt to make RTB applications on or after 1 August should be advised that RTB has been abolished. That advice could be in the form of a printed statement, or a standard letter, which should be drafted now and be ready for use at RSL offices from 1 August. The RSL’s website should also be updated to ensure that it also highlights the end of RTB.
