This session will cover the rights and obligations of insurers and policyholders in relation to disclosure and recovery of evidence from a civil and criminal perspective, including formal pre-litigation procedures such as Subject Access Requests and applications to the court under the Administration of Justice Act.

We will discuss:

  • The scope of pre-litigation recovery of evidence in civil cases in Scotland and tactics for responding to requests for evidence and information (Claire White).
  • Rules of Disclosure and Recovery of evidence in civil court cases (Jilly Petrie).  
  • The robust rules of disclosure in criminal cases; what that means for Insurers and Insureds alike, tactics and how best to deal with requests when civil/criminal cases run in tandem (Vikki Watt).  

The session will be followed by a Q&A panel discussion which will cover GDPR issues. Laura Irvine, a partner in BTO’s Data Protection team will be on hand to answer questions.
