This session will provide a useful update for insurers on a number of practical aspects of Regulatory law, including:
• Important developments in the law of legal privilege following the latest case from the Court of Appeal in England, R (HSE) v Paul Jukes 2018. This case is the second of three cases in the past year in which the assertion of legal privilege has not been upheld. We will look at what implications this could have for insurers, brokers and loss adjusters as well as the insured;
• The increasing use of Proceeds of Crime legislation to ‘claw back’ alleged financial benefit from criminal offences in Environmental Cases and an update on sentencing;
• A review of the impact of the judgement in D Geddes (Contractors Limited) v Neil Johnson H+S Services Limited paving the way for potential civil recovery from those providing negligent health and safety advice.
