  • Social Housing sector: During 2007, the team has been active in dealing with several high value loan facilities to organisations in the social housing sector. The team works closely with the firm’s Social Housing Unit enabling a focussed approach in this area, with the available expertise bringing benefits to both lenders and borrowers.

  • Acquisition finance and diligence: bto has been instructed by a number of banks to prepare the relevant banking documents for acquisition finance and to report to the banks on legal due diligence in the acquisitions. This has involved specialist reporting on heritable and intellectual property aspects. We have also reported to banks concerning financial assistance issues affecting commercial transactions.

  • Renewable Energy & Ethical Banking Finance: bto has acted in a number of funding projects for renewable energy and ethical businesses and charities, including community based social projects, fair trade enterprises and organic food and farming. Nursing Homes Sector: bto acted for an English based funder in relation to the Scottish aspects of the funding of the acquisition of a second phase of various let nursing home portfolios.

  • Property/Development Finance: We are appointed as the sole Scottish solicitors for a well known boutique lender specialising in property and development finance. As well as undertaking due diligence in numerous lending matters for the bank, we are instructed to develop a suite of lending and security documentation. In conjunction with an English legal firm, bto worked on a number of portfolio funding exercises for a major Irish bank in the nursing homes and retail/office sectors.
