Advising a large scale employer on a senior management restructure:
We advised a national telecoms related organisation on the restructure of its senior management team, including board directors. We liaised with the Chief Executive and the Finance Director to ensure that a proper procedure was followed so that the company could defend any subsequent claims for unfair dismissal. Our input to the restructure allowed the company to carry on its business as normal throughout the process. The restructure was successful, no claims were made and the business is thriving as a result of

Pursuing a disability discrimination complaint for an individual:
We pursued successfully a disability discrimination claim for an individual Claimant against her local authority employers. The case raised novel points in the field of disability discrimination and legal argument was heard around the issues of res judicata in respect of legal concessions made by the employer at an earlier Employment Tribunal hearing. We negotiated successfully a substantial settlement for the Claimant without the need to conclude the 22 day hearing.
Defending a sex discrimination complaint on behalf of an employer:
We guided successfully one of
bto
’s employer clients, a large worldwide employer, through complaints from a senior female employee of “institutional” sex discrimination within the workplace, bullying and victimisation, whistleblowing and work-related stress thereby ensuring that the client’s position was protected at all times.
Defending an individual in a race and sex discrimination complaint:
We defended successfully a senior medical professional in a complaint of race and sex discrimination raised by a colleague against him, four colleagues and the employer (a large public sector employer). The client had also been suspended from duties pending an internal investigation into certain decisions. We advised the client and his union in respect of the ongoing suspension and investigation in parallel with representing and defending successfully his interests in the Tribunal proceedings.
Defending a less favourable treatment claim for a further education institution:
We defended successfully a complex claim raised under the Fixed Term Employee (Prevention of Less Favourable Treatment) Regulations and Part Time Worker (Prevention of Less Favourable Treatment) Regulations. This claim was raised against our further education institution client and was potentially of very high value and affected a large number of our client's staff. This was one of the few cases to be raised in the Tribunal under these Regulations. The claim was settled on extremely favourable terms for our client. We used our in depth understanding of the Regulations to our client’s advantage in brokering settlement.
TUPE & the employment aspects of Large Scale Voluntary Transfers:
Acting for the emerging Registered Social Landlords (RSLs), we were instrumental in securing the successful completion of several Large Scale Voluntary Transfer (LSVT) in Scotland which involved the transfer of the housing stock and related assets and staff from the local authorities to the emerging landlords. We advised on the employment aspects of these multi-million pound projects which recently concluded successfully with the transfer to our clients of over 200 staff.
Defending race and disability discrimination claims against a public qualifications body:
Acting on behalf of a large public qualifications/professional body in Scotland, we defended successfully an unusual claim raised against them in the Employment Tribunal. The race and disability discrimination claim was raised by an English national who has dyslexia. The Claimant, the subject of a Vexatious Litigant’s Order issued by the English High Court, sought to obtain relevant qualifications and to secure relevant exemptions from the entrance requirements.
