- In 2007, Clare Bone represented clients, including individual employees and directors, in nine Health & Safety prosecutions, six of those being prosecutions on indictment in Sheriff and Jury proceedings. In three of those cases, Clare was contacted in the days after the incident to represent the client’s interests in the HSE investigations.
- In 2007, members of the team were instructed in respect of fatalities where either Fatal Accident Inquiries and/or Health & Safety prosecutions have followed or will follow.
Examples include:
- a high-profile diving Fatal Accident Inquiry
- a quad bike accident;
- an accident at a fairground;
- accidents in the marine, construction and industrial spheres, including crushing injuries and other work related accidents
- road traffic accidents.
In each of these the team is working with the clients as well as with HSE investigators, the Crown, expert and lay witnesses and police officers, together with insurers and other parties, or potential co-defenders, with a view to early identification of areas of dispute and resolution of matters where at all possible.
