Quantum Update (bto insight, September 2006)

The following case gives an indication of the level of award likely to be made for a whiplash type injury, the symptoms of which are ongoing for some two years post accident and which are expected to continue indefinitely.

In the case of Alison Spink v Jamie Lawrie 9 May 2006, Aberdeen Sheriff Court , the court held that an award of £5,250 was appropriate for solatium. The court heard evidence from the Pursuer herself and from a consultant orthopaedic surgeon. The Pursuer was absent from work for one week only.  However, at the time of the Proof she continued to suffer episodes of moderate pain. The episodes of pain although less frequent were no less severe. The prognosis given by the Pursuer’s expert was that the episodes of pain would continue indefinitely. The Pursuer was also awarded £400 for services provided by her husband and £50 which had been agreed for inconvenience.
