The law relating to disability discrimination was shaken last year by very significant decisions which have altered employment lawyers’ understanding of how the law is supposed to work. Disability discrimination claims can be complex with there being no limit on the amount of compensation a Tribunal can award following a successful complaint. Given these factors and the importance of avoiding such claims, this session will examine:
- What is the current state of play with regard to the law on disability discrimination?
- How is the law in practice likely to develop?
- What practical guidance on handling disability-related issues can we offer?
- What issues arise in dealing with absence management, reasonable adjustment and ill-health dismissals?
- What ways are there to limit potential damage to your organisation in this area, while also avoiding the risk of time-consuming and expensive Tribunal claims?
