Many Registered Social Landlords (RSLs) begin as charities and, increasingly, those that started up without charitable status are adopting it, or at least considering that possibility.

RSLs are subject to multiple regulatory regimes:

  • Their constitutional regulator: Financial Services Authority (FSA) or Companies Registrar
  • Where specific services are provided that require its regulation: for example, the Care  Commission.

To these, charitable RSLs should add:

  • The Office of the Scottish Charity Regulator (OSCR)
  • Charity tax regime as administered by Her Majesty’s Revenue and Customs (HMRC).

During this update session, Marion Davis, an Associate in bto’s Social Housing team, will consider:

  • Charity legislation / the charity test / non-charitable activities
  • Regulators’ roles / consents and notifications
  • Charity trustees / duties, liabilities and remuneration
  • Practical examples showing the part that charity law plays for an RSL.
