This session will focus primarily on dismissal by reason of misconduct. What does an employer need to do to ensure, so far as possible, that a misconduct dismissal will be upheld by a tribunal? How much proof of guilt is needed? What sort of investigation must be carried out? How should the evidence of informants be handled? What is the relevance of existing disciplinary warnings? How important is consistent treatment of different employees? When does the punishment fit the crime? What are the basic requirements of “natural justice”?
