Most organisations review regularly their operations to ensure that the organisation remains viable and profitable. That review sometimes results in decisions being taken to reorganise the workforce, make redundancies or outsource part of the organisation. Such decisions impact on employees’ rights and so care must be taken to ensure that the relevant procedures are followed.
This seminar provides a useful reminder of the general rules underpinning some of the commercial decisions organisations take. This will include a consideration of the pitfalls in managing redundancies and reorganisations and the relevant rights and obligations arising in this complex area of law and practice.
Some organisations outsource functions such as payroll or IT or bring such functions back in-house. This session will also look at this aspect of organisational change and the rights and obligations which arise under the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE). This will provide a useful reminder of the situations where TUPE can apply and what needs to be done to comply with the often onerous requirements found within TUPE.
