Event description :

This session will focus on a common reason for dismissal – “capability”. This reason encompasses two very different types of incapability: incompetence or lack of qualifications and incapability by reason of ill health.

The session will concentrate on providing practical hints for handling such dismissals. What procedural hurdles does the employer have to overcome when dismissing an employee for this reason? How much opportunity must an employer give an employee to perform to a satisfactory level? Will dismissal for poor performance ever be justified without prior warnings? What does an employer need to do to dismiss fairly in an ill-health situation? What differences are there in dealing with repeated short term absences rather than long term absence? And, how does the Disability Discrimination Act impact on this area?
