Advice on Enforcement Action by Planning Authorities

Where a planning authority considers a breach of planning law exists, it may elect to take a variety of enforcement actions.  Generally, this is only after giving notice that such action might be taken and offering a chance to rectify the situation. Such actions are time limited and bto can provide valuable advice on the extent, and limits, of planning enforcement powers.

bto has assisted clients who have been given notice of potential enforcement to address planning authority concerns and avoid being subject to full enforcement proceedings.

It may also be possible to provide evidence to counter an authority’s belief that a breach of planning has occurred.  We can assist in assessing this possibility and putting any available evidence to the authority.

If matters are more advanced and enforcement action is taken, bto can assist in responding to and, where appropriate and available, appealing against any such action.
