Consultation on new private tenancy introduced by Private Housing (Tenancies)(Scotland) Act 2016

The Scottish Government has published their Consultation on proposals for regulations and policy supporting the Private Housing (Tenancies) (Scotland) Act 2016 (“the Act”). The Act is set to replace the current regime of assured and short assured tenancies with a New Private Residential Tenancy from 1 December 2017. Any tenancies created prior to that date will remain unchanged.

The Act introduces a Recommended Model Tenancy Agreement with the stated aim of achieving greater uniformity within the sector.

A Consultation has recently been launched to obtain the views of interested parties on the Recommended Model Tenancy Agreement, Notices to be used by tenants and landlords, statutory terms and the option to serve documents electronically.
