Description:

“The thing about lying is, it is quite exhausting - you have to remember a lot.” Rupert Everett

Despite this, some wily pursuers often think they can successfully deceive insurers with a fraudulent claim. BTO’s experienced litigators have significant expertise in identifying “dishonesty red flags”.

Wendy Thomson, Partner and Solicitor Advocate, and Joanne Farrell, Associate in BTO’s catastrophic injuries team, have achieved success in a number of cases investigating, identifying and indeed repudiating fraudulent claims.  At this seminar Wendy and Joanne will cover the current position on the legal issue of “fundamental dishonesty” including consideration of the leading case in Scotland: Grubb v Finlay. They will compare the position in Scotland with that in England and consider how this important area of law for insurers is likely to develop in the future. Practical tips and guidance will be given under reference to case studies and attendees will leave armed with a tool kit to outwit even the most wily of fraudulent pursuers.
