Today, The Law Society of Scotland is hosting its Legal Risks Conference 2012 (29 March). Derek Allan, Partner and band 1 ranked professional negligence lawyer at bto solicitors has been invited to speak at the event along with Jacqui Donald, Senior Claims Technician, Professional & Financial Risks Claims, of RSA Group, in relation to “Residential Property Risks/Preventing Lender Claims.”
Derek and Jacqui are considering a practical approach to ensuring compliance with lenders’ (reporting) requirements. They are providing an introduction to claims and common errors (CML reporting, delay/failure to record). The number of claims and their impact is also on the agenda. It is not a question of lenders having slack lending procedures. It is about breach of contract.
The top 4 reporting requirements are being highlighted and how to manage your compliance/others in your firm. The speakers are also tackling practical concerns and how these can be addressed and underlining the need for a compliance checklist.
By looking at sample clauses, Derek is also providing a break out session on “Limiting your Liability.” This session focuses on how to cap the practice’s liability and on onerous terms and conditions within tenders and terms of appointment.
