Fast Track Litigation: Commercial Courts
BTO's commercial litigation team has vast experience in dealing with commercial litigation. Both the Court of Session and various sheriff courts offer commercial litigation procedures that are designed to "Fast Track" cases to a speedier resolution.
Parties are expected to come to court having fully explored the boundaries of any dispute and cases are managed aggressively by specialist commercial judges. From the outset those judges push past any delaying defences and force parties to confront the core issues in any case.
Today's commercial courts are likely also to allow parties to recover greater amounts of the fees incurred in contesting any action by way of penalising any party who has occasioned unnecessary expense.
