Recently, bto successfully obtained an Order from the Lands Tribunal for Scotland which was critical to our developer client. The Order removed title conditions that prohibited development and will allow our client to put the planning permission they had already achieved into action.
We worked on the application to the Tribunal closely with our client to ensure we had all the information that the Tribunal could require. This made the process, once the application was submitted, as smooth as possible making the case for our client strongly and discouraging any formal objections. As a result, the Tribunal was able to issue its Order swiftly and in a form that could be immediately registered on the Land Register.
Our client can now take forward development on their site, for which they already held planning permission, safe in the knowledge that out of date title conditions cannot be used against them to hinder or prevent that work.
