The Scottish Government consulted recently on two amendments to the Public Contracts (Scotland) Regulations 2006 and the Utilities Contracts (Scotland) Regulations 2006.
The amendments take account of:
1. the judgement of the Court of Justice of the European Union (CJEU) in the Uniplex case on the timescales for bringing court proceedings relating to breaches of EU procurement law.
2. amendments required to the 2006 Regulations to ensure that public bodies and utilities take the right approach to excluding tenderers from the procurement process who have been convicted of new offences in relation to bribery and serious organised crime.
